Final judgement in the lawsuit regarding imitation of Scan-Vibro products
The Supreme Court has on 30 June 2010 decided in favour of Scan-Vibro in the lawsuit against AB Vibrator.
AB Vibrator received a court order not to market and manufacture a vibration sifter, which is a copy of a sifter Scan-Vibro has manufactured for a number of years. AB Vibrator was enjoined to pay compensation and the court costs to Scan-Vibro.
The Supreme Court upheld the verdict of the Danish Maritime and Commercial Court from 19 January 2007.
Of course we are very pleased with the verdict of the Supreme Court, which was as we expected. The verdict proves that fortunately the system of justice protects innovative companies like Scan-Vibro A/S when exposed to imitation of products and sponging on goodwill.
From the course of this case (almost 5 years) we have learned that it is of the utmost importance to react both immediately and persistently to imitation of products. Especially when operating in a niche market like our, it is crucial to guard the goodwill of the company, which can be irreversibly damaged by product imitations.
In the future we will carefully oversee if AB Vibrator or others are violation our rights. We praise free and fair competition, but we cannot in any circumstances accept that our products are unlawfully copied. Record-breaking year
Scan-Vibro has finished the annual accounts for 2008 and it was a record-breaking year!
Both the turnover and the profit are the highest in the sixty-year-old history of the company.
The growth are founded on both the development of new machines, such as dryers for seeds, and the accession of new customers.
March 2009 Judgement re. copying of Scan-Vibro products
Recently Scan-Vibro A/S has been involved in a lawsuit at the Danish Maritime and Commercial Court regarding copies of our products.
The judgement was pronounced on Friday 19 January 2007 and to our delight the court sustained our claim that our rights had been violated.
The defendant, AB Vibrator ApS, received a Court order not to market and sell copies of our sifter type SRS.
